These Terms & Conditions (the “Terms”) together with the applicable Privacy Policy (collectively the “Agreement”) govern your access to and use of the Focus Fast website, applications, and services (the “Services”).

The Services are provided by Focus Fast (“Focus Fast,” “we,” “us,” or “our”). You may contact us at hey@focusfast.org.

Focus Fast reserves the right to update these Terms from time to time. The latest version will appear on our website with the date it was updated. Your continued use of the Services after changes means you accept and agree to those changes.

You must be at least 18 years of age to use the Services or purchase a subscription. By using the Services you confirm that you meet this requirement.

You are responsible for ensuring you have access to the internet and any compatible device required to use Focus Fast. We are not liable for any internet or data costs you incur.

The Services require a modern browser or device. We do not guarantee compatibility with all devices or operating systems.

To access certain features, you must register and create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be fully responsible for all activity that occurs under your account

Focus Fast reserves the right to suspend or terminate your account without prior notice if we reasonably believe there has been a breach of security or a violation of these Terms.

Subscription. Certain features of Focus Fast require a paid subscription. Your subscription begins when you complete the sign-up process and will automatically renew at the interval you selected (monthly or annually) unless you cancel before the renewal date.

Free trials. We may offer free trial periods. If you do not cancel before the trial ends, you will be automatically charged at the applicable subscription rate.

Payment. By providing a payment method, you authorize Focus Fast to charge the applicable subscription fee. You are responsible for any applicable taxes. All charges are non-refundable except where required by law or as outlined below.

Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.

Refunds. If you believe you were charged in error, contact us within 14 days at hey@focusfast.org and we will review your request. We do not offer refunds for partial subscription periods.

Price changes. We may change subscription prices from time to time. We will notify you at least 30 days in advance of any price increase. If you do not agree to the new price, you may cancel your subscription before the change takes effect.

You agree not to:

• Use the Services for any unlawful purpose or in any manner that violates these Terms
• Attempt to reverse-engineer, decompile, or extract the source code of our applications
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Services
• Share, resell, or sublicense access to the Services to any third party
• Circumvent any technical measures we use to protect the Services or audio content
• Interfere with or disrupt the integrity or performance of the Services
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

The Focus Fast hearing test and personalized EQ features are designed to enhance your audio experience. They are not medical devices and are not intended to diagnose, treat, or replace professional audiological evaluation.

The neural entrainment and amplitude modulation features are based on publicly available research. Focus Fast makes no guarantees regarding specific cognitive or productivity outcomes.

If you have a medical condition affecting your hearing or are concerned about your hearing health, please consult a qualified healthcare professional before using these features.

All content on Focus Fast — including audio tracks, software, design, graphics, and text — is owned by or licensed to Focus Fast and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use only. Nothing in these Terms grants you any ownership rights in the content or the Services.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the Services will meet your specific requirements.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOCUS FAST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

You may terminate your account at any time by canceling your subscription and contacting us at hey@focusfast.org to request account deletion.

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising from these Terms shall be resolved in the courts of competent jurisdiction.
